Marijuana Laws in California?

I heard that you could get prescriptions for marijuana use for simple troubles like headaches. Is that true? also is it true that there are stores that sell ready to smoke marijuana?
Answers:
The California Health and Safety Code states that "seriously ill Californians have the right to obtain and use marijuana for medical purposes where that medical use is deemed appropriate and has been recommended by a physician who has determined that the person's health would benefit from the use of marijuana..." The code goes on to list various illnesses, but also includes in the list "any other illness for which marijuana provides relief." Arguably, that could be headaches, if you could find a doctor to agree.

But that statute only provides a limited defense to possession, not the sale of marijuana, and the defense can only be used by patients and their "primary caregivers." This means no legal sale of marijuana in stores (or by cooperatives, or similar).

There may be Doctors giving out scrips for medical marijuana based on some simple ailments, but most Doctors supporting this cause need to have a medically documented situation. Just because you claim to have headaches isn't enough. You must have a medically documented history of these headaches. They will need your medical records showing that history. And yes, there are stores selling ready to smoke marijuana and other products as well that can be eaten. That is until the Feds show up and shut them down.
